Constitutional Law: Rights (Spring 2018)

This course will examine the history, doctrine, and theory of the Equal Protection and Due Process Clauses. Specific subtopics will include (but not be limited to) equal protection analysis of classifications on the basis of race, gender, and sexual orientation, fundamental rights guaranteed under substantive due process analysis, the judicial role, and (using the Second Amendment as an example) theories of constitutional interpretation. The rights guaranteed by the First Amendment are covered in other courses and will not be addressed here.
