Trademark Law in Practice (Spring 2018)

This course will teach students how to apply the law of trademarks to everyday practice. Through a series of take-home and in-class projects and exercises, we will examine a variety of issues that confront trademark users and their lawyers, including the selection and clearance of new marks, obtaining and maintaining a federal registration, the proper use of marks, the negotiation and drafting of trademark licenses and co-existence agreements, strategies for enforcing trademarks, and prosecuting, defending, and avoiding administrative and civil litigation.
There is no formal casebook. Instead, students will be assigned selected cases and use a variety of materials that will be posted to the Blackboard page for the class or that are available on-line from the website of the United States Patent and Trademark Office at www.uspto.gov, the website of the International Trademark Association at www.inta.org, and other sources.
Completion of the Copyright, Trademark and Related Rights course or the Intellectual Property course is a prerequisite to taking the course and familiarity with the fundamentals of trademark law will be assumed. We will spend limited time at various points in the course discussing trademark law concepts.
The course is two units. A student’s grade will be based upon the submission of weekly assignments and class participation. There will be no final exam. The course may be taken CR/D/F.
