Remedies LAW-625

The course will survey a wide variety of modern American litigation remedies, focusing on what a court can do for an injured Plaintiff.  We will cover the principal remedies such as compensatory and punitive damages, preliminary and permanent injunctions, declaratory judgments, restitution and unjust enrichment. In addition, the course will consider the historical distinctions between legal and equitable remedies, and also the contemporary justifications for how remedies protect substantive rights.  Time permitting, we will also briefly deal with arbitration as an overlay to the remedies landscape, often narrowing or sometimes vastly expanding available remedies.
