Television and Digital Media: Business and Production Issues (LLM Only) (Spring 2019)

Course Description

This course examines business and legal considerations that regularly arise in the context of television and digital media development, production and exhibition.  Through our examination of  issues that typically arise across multiple genres—including scripted, non-scripted, animation, live events, and sketch comedy—we will evaluate strategic approaches to achieving client objectives and resolving disputes through practical application of legal principles.  Topical coverage will include defamation (including libel in fiction and first amendment considerations), rights of privacy (including public disclosure of private facts, intrusion, hidden camera and surreptitious voice recording), rights of publicity (including a substantive evaluation of commercial and editorial speech), trademark (including nominative use), copyright (including fair use and de minimis use), idea theft, safety, security, illegal subject matter, indemnification and insurance.
