Course Description

This is an introductory course on the law of copyright, trademark, right of publicity and related rights.  The course focuses on how intellectual property statutes and case law impact the media, entertainment and other industries, and explores the tension between intellectual property rights and the First Amendment to the United States Constitution. The course adopts a practice-focused approach that analyzes intellectual property rights as a tool toward promoting client objectives in a transaction or dispute. Class participation is expected and strongly encouraged. This course does not cover patent law.  For students with interest in that field of law, Patent Law (Prof. Melnik) is being offered this semester and can be taken concurrently with this course.
