First Amendment (Fall 2019)

This course will provide you with an overview of all of the major issues typically covered in a First Amendment course. We will also spend some time exploring contemporary disputes with First Amendment implications. We will focus in particular on new burgeoning controversies concerning government speech. Class will cover several issues raised by the Trump administration’s use of social media, emerging legal perspectives on libel and incitement in the contemporary political climate, and renewed social concerns about false information and hate speech circulated on online platforms. We will not cover the religion clause, as religious freedom is typically covered in separate stand-alone Gould courses. A background in critical race theory or feminist legal theory will be helpful but is not required for the course.
